TERMS AND CONDITIONS FOR THE SALE OF GOODS AND THE PROVISION OF SERVICES BY ELECTRONIC MEANS
§ 1 Introduction
These Terms and Conditions specify the rules for using the online store available at www.woohoobikes.com, operated by Mirosław Szwed, conducting business activity under the name WooHooBikes.com, registered as a sole proprietorship in the Central Registration and Information on Business (CEIDG) kept by the Polish Minister of Economic Development and Technology. Business address: ul. Rudzka 38/3, 47-400 Racibórz, Poland, VAT ID: PL6391694428, REGON: 360005369.
These regulations define in particular the rules for placing orders and concluding sales contracts via distance communication means, as well as using other services provided through the online store.

§ 2 Definitions

Client – any natural person (including consumers) over 18 years of age, as well as legal entities or organizational units with legal capacity, who place or intend to place an order or use other store services.

Consumer – a Client who is a natural person placing an order not directly related to their business or professional activity.

Account – a personalized section of the store available after registration and login, allowing management of orders and customer data.

Terms and Conditions – this document defining the terms of sale and electronic services, pursuant to Article 8 of the Act of 18 July 2002 on Providing Services by Electronic Means.

Registration – the process of creating a Client's Account.

Online Store / Shop – the website available at www.woohoobikes.com enabling order placement and access to store services.

Party – the Client or the Seller.

Goods – movable items offered by the Seller through the Store.

Sales Contract – a contract concluded at a distance between the Seller and Client for the sale of Goods.

Service – electronic services provided by the Seller via the Store.

Seller / Service Provider – Mirosław Szwed, conducting business under WooHooBikes.com, ul. Rudzka 38/3, 47-400 Racibórz, Poland.

Act – the Act of 30 May 2014 on Consumer Rights (OJ 2014, item 827).

Order – the Client's declaration of intent to conclude a Sales Contract with the Seller.
§ 3 Obligations of the Parties

The Client agrees to use the Store in accordance with applicable laws and these Terms and Conditions, and to refrain from providing unlawful content.

The Seller undertakes to deliver Goods free from defects and in accordance with the Sales Contract.

If the Client is a Consumer, the Seller is obliged to deliver the Goods no later than 30 days from the date of concluding the contract, unless stated otherwise.
§ 4 Orders

Orders can be placed 24/7 via the Online Store. Registration is not required.

Orders are placed by completing the checkout process and clicking the "Order" button.

The Client may modify order details until the order is submitted.

Placing an Order signifies agreement with these Terms and Conditions.

A confirmation email with order details will be sent to the Client.

Upon receipt of the confirmation email, the Sales Contract is considered concluded.
§ 5 Prices, Payment, and Delivery

All prices are stated in Polish Zloty (PLN), Euro (EUR), or US Dollars (USD), including VAT.

Shipping costs are calculated during checkout and added to the total order value.

Mollie (including Google Pay, Apple Pay, local payment methods)

Bank transfer

Orders are processed after payment is received (unless otherwise stated).

Delivery is carried out by courier services or Polish Post. Delivery times vary by destination.

For damage or discrepancies, Clients should file a damage report and notify the Seller.
§ 6 Right of Withdrawal (Returns)

Consumers have the right to withdraw from a distance contract within 14 days without giving any reason.

The withdrawal period begins from the day the Consumer receives the Goods.

To exercise the right of withdrawal, the Consumer must send a written declaration to the Seller.

In the event of withdrawal, the contract is considered not concluded.

The Consumer must return the Goods within 14 days, at their own expense.

The Seller must refund payments within 14 days of receiving the withdrawal declaration but may withhold the refund until the returned Goods are received.

The Seller refunds using the same payment method unless agreed otherwise.

The right to withdraw does not apply in cases listed in Article 38 of the Act on Consumer Rights.
§ 7 Complaints and Warranty

The Seller is liable for physical defects in Goods under warranty.

Complaints may be submitted via email (contact@woohoobikes.com) or by post.

Clients may request:

Replacement of defective Goods

Removal of the defect

Price reduction

Withdrawal from the contract (except for minor defects)

Complaints are reviewed within 14 days.
§ 8 Quality Guarantee

Goods may be covered by a manufacturer’s guarantee. This does not limit the Consumer's statutory rights.
§ 9 Newsletter

Clients may subscribe to the newsletter to receive commercial information.

Subscription is voluntary and can be canceled at any time.
§ 10 Termination of Services

Either Party may terminate the use of electronic services at any time.

Termination occurs by deleting the Account or submitting a request for removal.
§ 11 Use of the Store

The Store provides:

Order status updates

Access to a Client Account

Access to some features requires registration.

Use of the Store requires an internet-enabled device with a supported browser, cookies, and JavaScript enabled.
§ 12 Dispute Resolution

Disputes with Consumers are resolved by competent courts under Polish law.

Disputes with Clients who are not Consumers are resolved by the court competent for the Seller's registered office.
§ 13 Personal Data

The Seller processes personal data in accordance with the GDPR (Regulation (EU) 2016/679).

Providing personal data is voluntary but necessary for order processing.

Clients have the right to access, correct, or request deletion of their personal data.
§ 14 Final Provisions

Consumers may negotiate individual terms of these Terms and Conditions.

In matters not covered herein, applicable Polish law shall apply.

The Terms and Conditions are available on the Store website at all times.

Product descriptions and prices do not constitute a binding offer but are an invitation to conclude a contract.

Intellectual property rights to Store content belong to the Seller or licensed third parties.
